The #FEEDYOURSOUL Campaign (“Campaign”) seeks to showcase Real Glory Stories from Real Glory People. Share your Glory Story about the moments, flavors and experiences that nourish you from the inside out. Glory Foods hopes to feature approximately one story per month in its advertising across media over the next year or so. If your story is selected to be featured, you will receive a year’s supply of Glory Foods products. Non-featured stories may still appear on Glory Foods social media profiles and website. See below for details.
There are two ways to share your stories: (1) share stories, photos and/or videos on Instagram or Facebook using #FEEDYOURSOUL and tagging @glory_foods; or (2) filling out and submitting the online form on the Glory Foods website at www.gloryfoods.com (“Website”).
By using #FEEDYOURSOUL and/or submitting a story via the Website, you confirm that you have read and agreed to these Terms and Conditions and agree to all decisions of Glory Foods related to this Campaign. By using #FEEDYOURSOUL and/or submitting a story via the Website, you also hereby grant to Glory Foods, Inc. (“Sponsor” or “Glory Foods”) a perpetual, worldwide, irrevocable, royalty-free license in and to the comments, stories, photos and/or videos (individually and collectively “Stories”) associated with the submission or post so that Glory Foods has the right to use, not use, display, post, publish, copy, edit, combine and create derivative works from the Stories in any and all media, worldwide, without limitation or further obligation to you or any other party. By submitting a Story in the Campaign, you confirm and represent that your Story is original to you, that you took the photo or created the video, as applicable, that you have obtained any and all permissions from any individuals appearing in the Story if any, you did not use any form of AI to create the Story, your Story has not been previously featured in advertising or promotional materials by you or any third party, your Story has not won previous awards, and your Story does not violate the intellectual property rights or other rights of any other person or entity. All Stories must answer the prompt about what feeds your soul and unrelated Stories will not be considered for use in the Campaign in Sponsor’s sole discretion. Stories referencing or depicting nudity, violence, discrimination, or other content deemed inconsistent with the GLORY FOODS® brand, as determined in Sponsor’s sole discretion, will be not be used, shared or featured. All Stories shared through posts on Instagram or Facebook must comply with all applicable policies and requirements of the selected platform.
Glory Foods will periodically post, share, like or otherwise react on its social media profiles and/or Website to Stories shared with #FEEDYOURSOUL or submitted through the Website. Glory Foods may edit, combine, or otherwise alter the Story, such as editing a video for length, cropping a photo, or excerpting a portion of a written Story, in its sole discretion, but such actions do not constitute “featuring” the Story for purposes of receiving the year’s supply of Glory Foods products. By submitting a Story on the Website or sharing a Story using #FEEDYOURSOUL you specifically agree to such use.
Glory Foods expects to select approximately one Story per month for approximately twelve months to feature in the Campaign, however, Glory Foods reserves the right in its sole discretion to select a smaller or larger number of Stories to feature, in its sole discretion. Glory Foods also reserves the right to shorten or lengthen the timeframe for the Campaign in its sole discretion and will provide notices about any material changes on the Website.
If your Story is selected to potentially be “featured” in the Campaign, a representative of Glory Foods will contact you via e-mail if you submitted your Story via the Website or by direct message on either Instagram or Facebook, depending on the platform used to share your Story. You are solely responsible for checking your e-mails and your direct messages to see if your Story has been selected. You must respond to the notification within the deadline set forth in the message with your full name and contact information. You will also need to sign and return a declaration and release form confirming your creation of the Story (and the other representations listed above) and your permission for Glory Foods to feature the Story in the Campaign. If any notification message is returned as undeliverable, or if you fail to timely respond to the notification message with your contact information, or if you fail to timely sign and return the required documentation, or if you are discovered not to have complied with these Terms and Conditions in any way, or if there is any question or dispute about the identity of the individual sharing or submitting the Story or the authority of that person to provide the rights and releases provided for under these Terms and Conditions, then Glory Foods will not feature the Story in the Campaign after all.
Some Stories may be featured as they were shared or submitted, with minimal editing. In other cases, Glory Foods may want to produce a video or otherwise create new content for the Story with the author/creator. In that case, Glory Foods will work with you to come up with a mutually agreeable plan for any new content creation, filming, or the like. Once all required documentation and agreements are in place and any new content has been created related to the Story for use in the Campaign, if applicable, the Story becomes a “Featured Story.” Featured Stories may show up in television commercials, print ads, social media posts, the Website and other advertising contexts in a variety of media throughout the Campaign. All Featured Stories will include attribution to the individual who originally shared, created and submitted the Story, expected to be in the form of first name, last initial, city and state of residence. All Featured Stories will appear on the Website under the “Featured Stories” header.
If your Story becomes a Featured Story, you will receive a year’s supply of Glory Foods products, awarded in the form of one case (12 cans per case) of Glory Foods products each month for 12 months shipped to your home address. Approximate retail value is $300. Glory Foods products will vary and will be selected in the sole discretion of Glory Foods. The first month’s supply of products will be shipped within six to eight weeks following completion of all documentation and agreements related to the Featured Story, with subsequent shipments arriving once per month for twelve consecutive months. It is the sole responsibility of the recipient to notify Glory Foods of any address changes during that twelve-month period. Recipients are solely responsible for payment of any applicable taxes, if any, related to receipt of the products.
You must be an individual resident of the 50 United States or D.C. who has reached the age of majority in your place of residence for your Story to be eligible for consideration as a Featured Story. Glory Foods may share Stories created by employees, officers and directors, advertising agencies, and contracted influencers of Glory Foods, as well as their respective family members (spouse, parents, children, siblings) and household members (residing in the same household for six or more months per year whether related or not) in the Campaign, but such Stories will not be eligible to become Featured Stories. There is no limit on the number of different Stories you share or submit during the course of the Campaign, but please do not share or submit duplicates. Glory Foods will scan all Stories submitted or shared to date throughout the Campaign when looking for potential Stories to feature, so the timing of sharing or submission does not affect the potential for your Story to become a Featured Story. If a single individual has more than one Story become a Featured Story, that individual will still only receive one year’s supply of Glory Foods products.
By submitting and/or sharing a Story on the Website or using #FEEDYOURSOUL, you agree: (a) to abide by these Terms and Conditions and all decisions of Glory Foods, which shall be final and binding in all respects relating to this Campaign; (b) to release, discharge and hold harmless Glory Foods, and its parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing from any and all injuries, liability, losses and damages of any kind to persons, including death, and including violations of publicity and/or privacy rights, or property, including infringement of intellectual property rights, resulting, in whole or in part, directly or indirectly, from the submission or sharing of a Story, participation in the Campaign, use of the Glory Food products provided for Featured Stories, or any other action or activities related to this Campaign.
Glory Foods is not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, or undelivered communications, messages or shipments; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, platform or other connections, availability or accessibility or miscommunications, failed computer, satellite, cable transmissions, mobile device, online, telephone lines or technical malfunctions or delays that may occur, or for telecommunications, network, electronic, technical or computer failures of any kind, including any damage to a user’s computer equipment or mobile device, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical or otherwise relating to or in connection with the administration of the Campaign, the uploading or downloading of any materials or websites, or for the incorrect or inaccurate capture of any information, or for failure of any e-mail, message, or materials to be received by any party for any reason. If you use a mobile device to share or submit a Story, standard data charges may apply from your carrier. Glory Foods is not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the Campaign. Should any portion of the Campaign be, in the sole opinion of Glory Foods, compromised by virus, worms, bugs, non-authorized human intervention or other causes which corrupt or impair the administration and security of the Campaign, Glory Foods reserves the right at its sole discretion to suspend, modify or terminate the Campaign. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CAMPAIGN MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, GLORY FOODS RESERVES THE RIGHT TO SEEK DAMAGES AND ANY AND ALL REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Except where prohibited, you agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this Campaign or any opportunity awarded or the use or non-use of any Stories submitted shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with sharing or submitting a Story, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of participants and Glory Foods in connection with the Campaign, shall be governed by, and construed in accordance with, the laws of the State of South Carolina without giving effect to any choice of law or conflict of law rules (whether of the State of South Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of South Carolina.
